Terms of Service

1. Agreement to these terms
These Terms of Service (the “Terms”) are an agreement between you and Soul Surferz, LLC (“Soul Surferz,” “we,” “us”), a Delaware limited liability company and the company that operates Dommi. They govern your access to and use of the Dommi mobile application and the website at dommisociety.com (together, the “Service”). By installing the app, requesting an invitation, creating an account, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
The Service is for adults only. You must be at least 18 years old to use it. By using the Service, you represent that you are 18 or older, that you have the legal capacity to enter into these Terms, that you are not barred from using the Service under the laws of your jurisdiction, and that your membership has not previously been ended by us for a breach of these Terms.
We ask for your date of birth when you create an account, and we record your confirmation that you are an adult. Giving us a false date of birth is a breach of these Terms and is grounds for immediate termination.
3. Admission to the House
Dommi installs from the App Store like any other app, and admission to the House is separate from installation. Anyone who meets the eligibility requirements in Section 2 may install the app, accept the House Tenets, and complete an application. Admission is granted in one of two ways: you enter a valid invitation code issued by us or by an existing member, or your application is read and a place is offered to you when one opens.
Admission is at our discretion. Completing an application does not guarantee that you will be admitted, and we may decline, delay, suspend, or revoke a membership where we consider it necessary to protect members or the integrity of the House. Membership is personal to you. You may not transfer, sell, or share it, and you may not hold more than one membership without our permission.
4. Your account
You may create your account with an email address, with Sign in with Apple, or with Google. You are responsible for the information you provide, for keeping it accurate and current, and for keeping your sign-in credentials secure. You are responsible for activity that occurs under your account. Tell us promptly at [email protected] if you believe your account has been used without your permission.
5. Conduct and consent
Every connection within Dommi begins with terms that both members set down and agree to. Consent is written, and it stays revocable. You agree to honor the terms you have agreed to for as long as they stand, and to respect any member’s decision to pause or withdraw, immediately and without argument.
You agree that you will not:
- Use the Service for any unlawful purpose, or to solicit or engage in any activity that is illegal where you or the other member is located.
- Harass, threaten, coerce, stalk, deceive, or endanger another member, or engage with anyone who has not freely agreed to engage with you.
- Involve, depict, describe, or attempt to reach anyone under 18 through the Service.
- Depict or solicit non-consensual acts, trafficking, or the sexual exploitation of any person.
- Share another person’s personal information without their permission, or record, screenshot, or redistribute another member’s portrait, Declaration, messages, or agreements outside the Service.
- Impersonate anyone, misrepresent who you are, or create an account on behalf of someone else.
- Upload content that is unlawful, that infringes the rights of others, or that you do not have the right to share.
- Advertise, solicit commercial sexual services, recruit for other platforms, or use the Service to sell anything.
- Interfere with, probe, scrape, or attempt to gain unauthorized access to the Service or its systems, or use the Service through an automated tool.
6. What a sealed Accord is, and what it is not
An Accord is a written record of terms that two adult members have set down and agreed to inside the Service. It is a social instrument: a shared, legible statement of what each person has agreed to at that time.
An Accord is not a legal contract, and nothing in it is legally enforceable between members or against us. It does not create, transfer, or waive any legal right. It is not a substitute for consent, and it can never serve as evidence of consent to anything that happens outside the Service. Consent under the law is given in the moment, by the person whose consent it is, and it can be withdrawn at any time regardless of what any Accord says.
Sealing an Accord marks agreement to the terms as they stand at that moment. It is not a permanent consent. Either member may pause, amend, or revoke an Accord at any time, for any reason, without penalty and without explanation, and the Service is built to make that possible at every stage. No title, role, or Standing in the House grants any member control beyond the terms the other person has accepted, and no Accord may authorize anything unlawful where either member is located. Where an Accord and the law conflict, the law governs.
7. Your content
“Your content” means everything you submit through the Service, including your Declaration, your portrait and any other media, the clauses of your Accords, your Ritual entries, and the messages you send to other members.
You keep ownership of your content. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your content, and to make the technical changes needed to transmit and present it, only as necessary to operate and provide the Service to you and to the members you choose to share it with. This license exists so we can run the Service. It ends when you remove the content or your account is deleted, except for copies retained in backups for a limited period, copies we must keep by law, and content that another member has already lawfully received.
You are responsible for your content, and you represent that you have the rights necessary to share it and that it does not break these Terms. We may remove content that violates these Terms, and we may preserve content where we are required to or where it is relevant to a safety report.
8. Moderation and enforcement
The House reviews conduct. You can report another member or raise a safety concern from within the app or by writing to [email protected] with “Safety” in the subject line. We read reports and act on them.
Where we find a breach of these Terms, we may remove content, limit your access to features, adjust your Standing in the House, suspend your membership, or end it permanently. Serious breaches, including anything involving a minor, non-consensual conduct, or a credible threat, will end a membership immediately and may be reported to law enforcement. We are not obliged to monitor the Service, and reviewing some content does not make us responsible for all of it.
9. Purchases, subscriptions, and billing
Dommi offers optional paid features. These may include auto-renewing subscriptions that provide premium expression, insight, and priority, and one-time (consumable) purchases such as refreshing the set of members presented to you. Prices, the billing period, and the features included are shown to you in the app before you buy.
- Purchases made in the iOS app are processed by Apple through your App Store account and are charged to your Apple ID at confirmation. We never see or handle your card details.
- Subscriptions renew automatically for the same period and at the same price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- You can manage, restore, or cancel a subscription in your App Store account settings, and the app links you there. Deleting the app does not cancel a subscription, and neither does deleting your member record.
- Consumable purchases are delivered immediately and are not refundable once delivered, except where required by law.
- Refunds for App Store purchases are handled by Apple in accordance with its policies. Any free trial or introductory offer converts to a paid subscription unless you cancel before the trial ends.
- We may change prices or the features included in a paid tier. Where a change affects an active subscription, it takes effect at your next renewal, and you may cancel before then.
Paid features sell expression, insight, and priority. They never sell more connections or the ability to buy reach over other members, and they never buy admission to the House.
10. Third-party services
The Service relies on third parties, including the Apple App Store for distribution, sign-in, and billing, Google for sign-in, Supabase for hosting, database, authentication, and file storage, Expo for delivering push notifications, and Superwall for presenting paid offers. Your use of those services may be subject to their own terms. We are not responsible for third-party services we do not control. Section 7 of the Privacy Policy explains what each of them receives.
Apple is not a party to these Terms. Apple has no obligation to provide support for the app, and to the extent any warranty is not effectively disclaimed, you may notify Apple and Apple will refund the purchase price of the app, if any. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
11. Termination and departure
You may leave at any time. Departing the House from within the app ends your membership, closes every live dynamic you are part of, retires your active Rituals, and notifies each counterpart that consent has ended. Records that were already sealed remain readable to the members who were party to them. You can ask us to restore your membership later.
Departing is not the same as erasing your information. To erase it, open House settings in the app and choose Delete this member record. Deletion takes effect immediately and is permanent. It removes your sign-in account, your member record, your Declaration, your portrait and any other images you uploaded, your Accords, your messages, and the notification tokens held for your devices. It cannot be undone, and your membership cannot be restored afterward. If you may want to return, depart instead.
If you cannot reach the app, because you have lost access to your device or cannot sign in, write to [email protected] and ask us to delete your account. We handle written deletion requests as described in the Privacy Policy.
Deleting your account does not cancel a subscription. Subscriptions are sold and billed by Apple, and they keep renewing until you cancel them in your App Store account settings. Cancel there as well if you no longer want to be charged.
We may suspend or end your membership if you breach these Terms, if we are required to by law, or where it is necessary to protect members and the House. When your membership ends, your right to use the Service stops, and any unused portion of a paid subscription is handled under Apple’s refund policies. Sections that by their nature should survive termination, including Sections 7, 12, 13, 14, and 15, will survive.
12. Disclaimers
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error-free.
Dommi does not conduct criminal background checks on members and does not verify that members are who they claim to be. You are responsible for your own interactions and for any decision to meet or engage with another member. Take reasonable precautions, appoint a Guardian, and use the safety features the Service provides. We are not responsible for the conduct of any member, whether online or in the real world. Nothing in the Service is legal, medical, or psychological advice.
13. Limitation of liability
To the fullest extent permitted by law, Soul Surferz, LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. To the extent liability cannot be excluded, our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred United States dollars. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless Soul Surferz, LLC from any claims, damages, and expenses, including reasonable legal fees, arising out of your misuse of the Service, your content, your conduct toward another member, or your breach of these Terms, to the extent permitted by law.
15. Governing law and disputes
Soul Surferz, LLC is a Delaware limited liability company. These Terms are governed by the laws of the State of Delaware and the federal laws of the United States that apply there, without regard to conflict-of-laws rules. You and Soul Surferz, LLC agree that any dispute arising out of or relating to the Service or these Terms will be brought exclusively in the state or federal courts located in the State of Delaware, and each of us consents to the personal jurisdiction of those courts and waives any objection to that venue. This does not remove any right you have under the law of your own country or state to bring a claim there.
Before filing a claim, you agree to contact us at [email protected] and give us 30 days to resolve the matter informally.
16. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, notify you through the Service. Your continued use of the Service after an update means you accept the revised Terms. If you do not accept them, depart the House and stop using the Service.
17. General
These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any part of them is found unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
